    Where do I find a copy of the Will?

    For extra protection, we always register wills created with us with the National Will Register at no extra charge. So if the will is not found in the deceased person’s property (for example in a filing cabinet), it may be found by searching with the National Will Register.

    Alternatively, it could be held by his or her solicitor or a bank.

    How do I know the Will is valid?

    The Probate Registry office will tell you if the will is valid or not, and why. There are lots of reasons why a Will can be invalid, for example, if it is not witnessed and signed properly, or if the testator did not have testamentary capacity (they were not of sound mind when the will was made).

    This is why our approach is extra careful when preparing wills.

    Who can contest a will?

    A will can be contested by, financial dependents not provided for, promised heirs not included, or on grounds of testamentary capacity or undue influence. The contestant does not have to be a family member.

    Who will my money go to if I don’t leave a Will?

    The default order of inheritance for your estate is as follows: surviving spouse or registered civil partner (common law spouses, partners or cohabitants are not included), children, parents, brothers, sisters, grandparents, uncles, and aunts. If no surviving relatives are found, the assets will be passed on to the Crown.

    With this in mind, it is highly recommended to leave a will to ensure that your estate is handled according to your wishes.

    Will my beneficiaries have to pay Inheritance Tax?

    Inheritance Tax must be paid on estates valued at over £325,000. Due to the rise in property prices over the past decade, more individuals are now liable to pay Inheritance Tax.
